HUD Releases New Guidance on Fair Housing Act and Usage of Criminal Records

On April 4, 2016, the U.S. Department of Housing and Urban Development Office of General Counsel issued guidance that outlines how the Fair Housing Act applies to the use of criminal records for housing related dealings. The guide highlights that housing providers are in violation of the Fair Housing Act when they implement policies and practices that have either an intentional or unintentional housing discriminatory effect against individuals with a prior criminal history, especially if these practices are shown to discriminate because of an individual race, national origin or other protected characteristics.

It also provides an overview of how discriminatory housing policies are evaluated to determine whether a housing policy based on prior criminal records violates the Fair Housing Act.
