The U.S Department of Housing and Urban Development (HUD) released a final rule on the Implementation of the Fair Housing Act’s Discriminatory Effects Standard. The new rule creates a national disparate impact rule that will act as a standard for HUD to review whether a given housing practice has resulted in a discriminatory effect.
This move is part of HUD’s statutorily charged responsibility to interpret and enforce the Fair Housing Act and it has traditionally interpreted the Act to prohibit housing practices with an unjustified discriminatory effect.
